Bromley Catholic Primary Schools Cluster

In response to the Local Authority’s decision to require all its schools to convert to academy status, the Catholic Primary Schools in Bromley came together to convert as single academy trusts and to formalise their pre-existing collaboration under an umbrella trust. We advised each of the Governing Bodies and the Diocese, who led on the arrangements for the umbrella trust whilst recognising that the umbrella trust was ultimately going to be controlled by the Schools. The formality of the collaboration means that the Schools can be more focussed about the sharing of resources, which is becoming more necessary in response to the pressure on budgets, and can better plan to undertake joint professional development for their staff. This reinforces their identity as a family of Catholic schools, supported by the Diocese.

Cardinal Hume Academies Trust

St George’s Catholic School in Maida Vale, London wanted to become an academy but preferred not to join The Diocese of Westminster Academy Trust. This was partly in recognition of the role that the headteacher and the executive team play in supporting other schools, formally acknowledged by the DfE as that of a sponsor. St George’s set up a multi academy trust which reinforces St George’s role as sponsor and the second school to join was St Thomas More, Haringey, which the headteacher was also the executive head of. Both Schools were complicated conversions (for different reasons) with outstanding statutory transfers of land, significant budget deficits and ongoing building works under the Building Schools for the Future programme. The Schools continue to thrive and St George’s is now expanding to add a sixth form which we are also advising on.   

Kent Catholic Schools’ Partnership

We acted for the Diocese and for its schools in the creation of the Kent Catholic Schools’ Partnership.  This was set up with the aim of welcoming all 32 Catholic Schools in Kent County Council into its membership.  Once all conversions are complete this will be one of the largest Academy chains in England.  We are currently converting its 21st school.

KCSP and its schools are also members of our School Support Service and we continue to support them on a range of queries including employment problems, land issues and governance queries.

Xavier Catholic Education Trust

We advised the Diocese of Arundel and Brighton on key governance and structural issues and produced model documentation for multi academy trusts within the Diocese. Having completed this structural work we advised nine schools who are forming the first Diocesan multi academy trust called the “Xavier Catholic Education Trust”.  This work involved dealing with a variety of land issues including leases granted by the Diocese to the LA, an adverse possession claim, statutory transfers under the School Standards and Framework Act 1998 and drafting an unusual Church Supplemental Agreement which takes into account a lease by the Diocese from a Religious Order.  The Schools all converted on the 1st September 2016.

St Patrick’s Catholic Primary School

We have supported St Patrick’s Catholic Primary School since March 2012, firstly with their conversion from voluntary aided to academy status, and then with a wide variety of legal issues under their School Support Service membership and on receipt of substantive instructions.  In particular, we have helped them to challenge proposed placements of very high needs children with special educational needs at their one form entry school, have completely overhauled and re-drafted their admission arrangements to ensure compliance with the law, and have supported them in relation to an objection lodged with the Schools Adjudicator against them.
