We advise on every element of alternative disputes resolution including mediation and arbitration. Our team, led by Marie-Louise King, takes a pragmatic approach, recognising that going to court is often the least welcome course of action for our clients. We pride ourselves on our ability to help our clients resolve their disputes without litigation.

We advise clients ranging from private individuals to social housing providers, to listed and privately owned businesses on every day issues as well as complex and large contract disputes. Our role is to protect our clients' interests and work closely with our colleagues in other parts of the firm to ensure that our clients are aware of potentially contentious aspects of the commercial contracts they enter into. The team’s experience includes:

  • representing a dairy processing company in a dispute arising from the interpretation of its contract with a plastic bottle supplier
  • acting in a dispute between a trust, provider of HR/payroll services to schools and academies, and a supplier of software
  • assisting  parties to achieve a negotiated settlement of a dispute relating to the provision of vehicle tracking systems to a wholesale supplier business
  • advising on the enforceability of retention of title clauses, often in the context of an insolvency event
  • representing a government agency in a breach of contract dispute relating to a contract for the supply of IT services
  • acting for a provider of adult education, defending various claims brought by former students for alleged breach of contract
  • defending a tenant management organisation against allegations by a council of failure to comply with its obligations under a management agreement
  • acting for an educational charity in the defence of a claim by a service provider to enforce an onerous contract
