We advised One Housing Group Limited on the acquisition of three sites in Lewisham for the Merchant Taylors’ and Christopher Boone’s Almshouse Charity, a major provider of charitable housing, to develop 114 new homes of private sale, retirement housing and affordable housing for rent.

The first site, the Merchant Taylors Almshouses, is to be redeveloped to provide 19 units within its existing Grade II listed structure with a further 5 new-build units. The redevelopment requires careful consideration due to the Grade II listed building status.

The second site, at the Christopher Boone Almshouses, will provide a block of 62 flats, 8 new-build villas as well as 18 flats. Over 30 of the almshouses will be leased back to the charity, with the others being sold privately.

The third site, at Blessington Close will feature affordable housing for rent.

This matter involved a complex timescale management process for the property transfers, as the first two sites were occupied by elderly people at the time of negotiations. Provision was therefore made to stagger possession and for the development plans.

We also overcame issues surrounding the vires of the disposal by the Christopher Boones Almshouse charity, and in relation to securing appropriate consents. Other issues included:

  • questions surrounding the tenure of units prescribed by the planning permissions that had been secured
  • potential rights to light issues
  • establishment of a scheme of land management for units adjoining the third site

The charity was established in 1683 and the first site had been in its ownership since 1880. It was therefore concerned to ensure control over the intended development (and particularly the design process).  This had to be balanced with our client’s desire for an efficient development project.
