City executive loses discrimination case

An employment tribunal has ruled against a female City executive in a £4 million sex discrimination case.
Jordan Wimmer had claimed for sex and disability discrimination, as well as unfair constructive dismissal, against Mark Lowe of the hedge fund Nomos Capital.
Mr Lowe was accused of making disgusting and demeaning comments to Ms Wimmer, as well as bringing female escorts to business meetings.
However, Mr Lowe insisted that the woman in question was a former girlfriend who attended a social event out of working hours.
He also refuted suggestions from Ms Wimmer that he had hired a hitman to kill her.
The tribunal said Ms Wimmer's attempts to corroborate her claims of sexual harassment during the course of the hearing were not successful.
It also stated that her "dramatic account" was not backed up by the "overwhelming totality" of the contemporaneous documents.
"We did not find the claimant a persuasive witness," it concluded.
Sue Kelly, an employment law partner at Winckworth Sherwood solicitors said: "This case is a reminder of the obvious point that claims must be supported by evidence.
"Contemporaneous documents will nearly always carry more weight with the Tribunal than oral evidence, which can so easily be denied."
This comes after the Tribunals Service reported a 29 per cent increase in the number of unfair dismissal cases during 2008-09.
