National data protection authorities to cooperate on changes to law

Thu 05 Aug 2010

National data protection authorities are to work with the European Commission (EC) on updating the relevant legislation.

A spokeswoman for Viviane Reding, the justice and rights commissioner at the EC, told the Register that they will work in "very close cooperation" with European officials.

This, she stated, is necessary because these bodies will have to enforce the revised data protection laws in their respective nations when they are put in place.

The spokeswoman also confirmed that the publication of the planned revisions will be put back to some time in 2011.

Ms Reding had originally planned to release details of the proposed updates before the end of this year.

The changes will be designed to accommodate technological and lifestyle developments that have occurred since the Data Protection Directive was introduced 15 years ago, such as the emergence of online social networking.

UK justice minister Lord McNally recently invited members of the public to air their views on whether or not they believe current data protection laws are effective.

James Oxley, a solicitor at Winckworth Sherwood, commented: "It will always be difficult for legislators to keep up with the pace of technology, but any review to facilitate the application of the law to new technology must be welcomed."
