Nemcova v Fairfield Rents Ltd: Short Term Lettings

The majority of long flat leases contain a covenant restricting the tenant’s use of the property to that of a “private residence/dwelling". This briefing looks at the recent case of Nemcova v Fairfield Rents Ltd [2016] UKUT 303 (LC), and the decision by the Upper Tribunal that a short term letting would constitute a breach of the covenant prohibiting use of a property other than as a private residence.
