Winckworth Sherwood acts on 800 Home Zero Carbon/Affordable Homes Regeneration Scheme

Winckworth Sherwood has advised the Affinity Sutton Group housing association on all legal aspects of a partnership between them and the Galliford Try group in relation to the former Graylingwell hospital site at Chichester, West Sussex.

The partnership was created following on appointment of both parties by the Urban Regeneration Agency (English Partnerships) in October 2007. 

The development will be set in 90 acres of historic parks and gardens of historic interest and will provide approximately 800 homes and commercial/ community buildings of which 40% will be affordable.   Existing buildings include  a Grade II listed farmhouse and chapel which  will be preserved and renovated.

The development is conceived as a landmark sustainable scheme providing high quality net zero carbon building design.

Andrew Murray, who heads the firms' leading housing development practice, led the Winckworth Sherwood team that included: Anna Clark and Patricia Umunna who advised on the funding aspects, Neil Morgan who created the partnership agreement; John-Paul Buck who assisted on the development documents; and Jenny Scott-Russell and Eleanor Kilminster who advised on construction matters.

Commenting on the project, Andrew Murray said: "This was an exciting project in which to be involved.  The need to satisfy the complex requirements of English Partnerships and the conditions of the third party finance arrangements, while creating a project that would be viable in the context of the required planning permissions and the wish to generate a return on investment created challenges both in the negotiation of the transaction and the preparation of its governing documents.  By working closely with Affinity Sutton and together as a team, we were able to ensure that all aspects of the deal were properly considered, allowing us to protect the best interests of our client and those of the joint venture vehicle we had created".
