Emma heads the Property and Dispute Resolution Team which specialises in all aspects of property litigation and landlord and tenant disputes. She is a Solicitor Advocate and former Barrister and has expertise in commercial landlord and tenant disputes including service charge disputes, contested lease renewals, dilapidations, forfeiture, breach of lease covenants and property related insolvency issues. In addition, Emma has experience of boundary disputes, adverse possession and contractual property disputes including those affecting large and small scale developments. She also deals with telecommunications disputes.

Emma has experience of acting for clients involved in mediation and arbitration.

Emma advises government agencies, RSLs, other institutions, corporate clients across a variety of industries and individuals with property portfolios and her work can often call for particular political or commercial sensitivity.

Recent experience

  • Acting for an RSL in a dispute with a commercial tenant requiring an injunction to restrain unauthorised works and thereafter forfeiture of a long lease.
  • Acting for an ecclesiastical institution in a complex boundary dispute with an adjoining land owner.
  • Advising a government agency on its tenants various breach of covenants in a commercial lease resulting in assignment of lease and forfeiture issues.
  • Advising managing agents on the recovery of residential service charges across developments.
  • Advising a telecommunications operator on contested lease renewals and Telecommunications Code issues.
  • Advising an intermediate landlord on tenant unauthorised works including injunctive relief where structural works undertaken.
  • Providing advice to the charitable sector on landlord and tenant issues concerning tenant insolvency and recovery of rent.
  • Advising an institution on a complex lease renewal on a site with development potential.
