Ian Pease

Position: Solicitor

Ian is a specialist in construction and engineering law. He has successfully acted for major contractors, professionals, public authorities and specialist subcontractors in connection with a wide variety of projects.

His experience ranges over all the major domestic and international forms of contract both in relation to contract procurement and on all aspects of dispute resolution including mediation, arbitration, litigation, and adjudication.

From his early pioneering work in the mid 1990s, Ian has been particularly involved with how new technology can aid clients in advancing their positions.

Recent experience

  • Colour Quest & others v Total (UK) Ltd. & others - The Buncefield oil storage explosion: ongoing heavy weight litigation in the Commercial Court. (2008-9).
  • Qatar Chemical Company Ltd, ethane cracker Mesaieed, Qatar - advising JV (Technip / Kellogg Brown & Root) on disputes under an engineering, procurement, and construction (EPC) contract. Working in conjunction with a US law firm. Case eventually settled without a formal dispute process. (2006)
  • Henry Boot Construction Ltd v ALSTOM Combined Cycles Ltd (2005 1BLR 437) (Court of Appeal) (2005). Successful appeal, the court giving guidance on the arising of causes of action in engineering contracts.
  • ApiENERGIA - IGCC power station, Falconara, Italy: Reporting to the board of the project company in relation to delays by the contractors and failures to meet the contractual specification. Advising ApiENERGIA generally and producing a report on the contractor's claims. (2002).
  • NLNG Plus Project Bonny Island, Nigeria (2000): General contractual and commercial advice to the client.
  • ALSTOM Combined Cycles Ltd v Henry Boot plc (2001). Successful application for stay of proceedings on action under a parent company guarantee.
  • Henry Boot Construction Ltd v ALSTOM Combined Cycles Ltd (Court of Appeal) (2000 1 BLR 247). Successful appeal, court giving guidance on the valuation rules under ICE Conditions of Contract 6th Edition.

  • The rule of war - NLJ 15.10.10 at p 1397 : Ian Pease & Francis Neate debate below how the rule of law can be upheld in that most critical of decisions - that to go to war.
  • The thin blue line - P.L.J. 2010 252 p12-14 - Examining new case law on the interpretation of construction operations under the Housing Grants, Construction and Regeneration Act 1996
  • Mind your language - P.L.J. 2010 250 p19-21 - discussing two cases showing the difficulty of applying the rules of contractual construction.

Personal interests

Ian is a keen golfer. When not on the golf course, he also enjoys cycling and walking to keep fit.
