Jim Rai

Position: Partner

Core Areas: Dispute Resolution

Jim leads the commercial litigation team, which focuses on commercial/chancery disputes including banking, finance, insolvency and professional indemnity. He is an ADR Accredited Mediator.

Jim advises clients in a number of industry sectors, ranging from multi-international corporates through to prominent UK government agencies. He regularly acts on professional negligence claims involving solicitors, accountants and financial advisors. His cases also involve a number of high profile foreign claims, some of which proceed through multiple jurisdictions as well as through the ICC Arbitration.

Jim has led a number of significant class actions, the most notable of which involved a leading retail bank in connection with irregularities on currency exchange procedures. The action which directly/indirectly affected several thousand individuals as well as companies was eventually resolved through a bespoke adjudication/arbitration scheme.

 

Recent experience

  • Acting for a large group of corporates and mid-ranking companies against a major retail bank in respect of fiduciary breaches
  • Acting for a significant international undertaking in connection with the breach of a complex structured finance agreement
  • Successfully defending a claim bought by a leading company for misrepresentation in respect of sales and purchase agreement
  • Acting on behalf of a government intelligence agency in relation to a claim of negligence against various oil related companies
  • Acting for an RSL in an action against a developer and its consultants for the defective design of a care home under a design & build contract, in which the outcome of the action was successful and the RSL was awarded the cost of rectifying the defects and was compensated for income loss and other consequential losses
