Nicola Raistrick

Position: Partner

Nicola acts for a wide range of clients including local authorities, public authorities, developers and retail companies on all aspects of planning and environmental law. She deals with both non-contentious and contentious work including public inquiries, High Court litigation and infrastructure and development agreements. She has extensive experience in drafting planning agreements, advising on compulsory purchase and local government issues. She also advises on the issues relating to the development of land including the contaminated land regime, IPPC regime, warranties and indemnities in corporate and property transactions.

Nicola has specialist experience in negotiating and drafting documents on behalf of both house builders and local authorities. She can also provide pre acquisition advice and regularly advises on contracts to acquire housing sites that are conditional on planning.

Recent experience

  • Acting for a major landowner in obtaining planning permission for residential consent on a 10 acre site
  • Acting for a regional development agency on an 80 acre regeneration site (which includes a proposed marina). The agency was working in collaboration with the local council to bring about a significant regeneration including a marina and mixed use residential office and leisure scheme
  • Advising a local authority on the compulsory acquisition of a major regeneration site required for employment purposes. Advice included reviewing the statutory powers of both the Council and the regeneration agency and agreeing a strategy with members of the Council
  • Acting for a major marina operator in obtaining consent for a new 600 berth marina in readiness for the 2012 Olympic and Paralympics games including advising on the complex Environmental Impact Assessment, and HSE consent and negotiations with the Olympic Delivery Authority
  • Advising a leading Biofuels company on the issues arising from their need to obtain consent for a major Biofuels plant including advice on IPPC HSE and COMAH consent; need for, scope and extent of the assessment; content of the application; and avoidance of judicial review and other appeals
